Terms & Conditions for Use of The Beachfront Club Website

1. general

a) The Terms & Conditions herein apply to all persons using this website except Hotel and Restaurant Members. However, when representatives of registered Hotel or Restaurant Members are logged in privately through an account separate from the hotels' they are subject to these Terms & Conditions as private individuals.

b) Hotel and Restaurant Members' use of this website is governed by the separate terms called 'Terms & Conditions of Hotel Membership in The Beachfront Club'.

c) Other Terms & Conditions and policies of The Beachfront Club apply to specific policies of or specific actions within the website and are delineated in these additional documents which along with this and the Hotel Members' terms in 1 b) form the entirety of The Beachfront Club's Terms & Conditions:

d) Your accessing and using the website of The Beachfront Club constitutes your agreement to read, accept and agree to all Terms & Conditions of the BFC. Your use of The Club's website and its related software and systems is at your sole discretion and responsibility.

e) These Terms & Conditions may be updated and changed at any time without advance notification. It is your responsibility to check this page from time to time to read any such updates or changes that might affect you.

2. provision of service

a) This site is provided on an 'as is' and 'as available' basis. We do not guarantee that the services of this website will always be available nor do we guarantee the accuracy of the information contained within the site. The BFC will not be held responsible for loss, damage or infringement of another party's rights of any kind suffered by a user as a result of the use of the site, the content within it nor by interactions with third parties contacted through this website.

3. private use only

a) The BFC website is provided for personal, non-commercial use only and you should not exploit it or any content, software or systems within it in any way for commercial gain, including but not limited to not selling any photos, materials, products, software or services obtained from this site. Maps, photos, text and other content may be downloaded, stored in personal computers and printed only for private use in the spirit of this website.

4. contributions of text, photos and content

a) The uploading of photos is governed separately by the Terms & Conditions of Uploading Photographs to The Beachfront Club. Please read those before uploading photos.

b) When uploading comments, reviews, written content and all other content you must guarantee that these materials are true and correct to the best of your knowledge, and that you have full rights to upload such content and doing so does not violate the copyrights or any other rights of any other person or entity.

c) By uploading texts, reviews, contributions, communications and other content to this site the user assigns to The Beachfront Club the irrevocable right to display, use, distribute, edit or change these materials as it sees fit in perpetuity.

d) If the BFC finds any content uploaded by any party to be irrelevant to the needs of the website, offensive or otherwise unsuitable for inclusion within the website it may at its own discretion delete any such content at any time without giving notification or explanation.

e) The BFC accepts no responsibility for the failure to store or display any user content including text, communications or personalised settings, nor for the correctness of such information or settings.

5. ratings & reviews

a) Ratings and reviews of Hotel and Restaurant Members, beaches and other attractions (hereafter called 'reviews') may be posted to the website by users. The BFC has a policy of no tolerance for fake reviews, and will do its best to ensure that all reviews are posted by genuine guests who have stayed overnight in hotels they review or by persons who have visited the location they review.

b) Hotel Members will be given an opportunity to reply to reviews should they wish.

c) All reviews will be assessed by an editor of the BFC before being posted to the site. Any review that is suspected of being fake and/or without substance may be deleted without being posted. The decision to post or delete a review will be made by the BFC alone and its decision will be final.

d) Reviewers warrant that they will only review hotels in which they have stayed as an overnight guest and will not post reviews that are fake or without substance.

6. copyright on content

a) The Beachfront Club does not claim any rights of ownership or copyright on any form of text content uploaded by a single user, be it a review, comment, travel tip or text written into our 'wiki function'.

b) However, all text content written into the wiki function that has multiple authors becomes the sole property of the BFC which exercises all rights of copyright over such multiple-author texts. You may not copy, reproduce or otherwise display such texts for any commercial purposes or in any public forum without our written permission. You are welcome to copy and print such texts for your personal use only.

c) If you have reason to believe that someone has infringed upon your or a third party's copyright please notify us by following the procedures under 'Flagging' found under the Global Navigation Bar/ 'community'.

7. user accounts

a) You are expected to provide true and accurate information in your user account and to keep it updated. You are responsible for maintaining the confidentiality of your own password, and for changing it from time to time. You are solely responsible for all uses of your account. If someone else accesses and uses your account without your authorisation The Beachfront Club will not be held responsible and you agree to notify the BFC immediately.

b) All use or misuse of your account with the BFC is beyond our control, and we will not be held responsible for any loss, damage or infringement of another's rights by you or any third party resulting from the use or misuse of your account or of the BFC website.

8. member contacts & bookings

a) The Beachfront Club relies on information provided by others that in most cases it cannot check or verify for accuracy. The BFC contains info about, links to and sometimes recommendations for member hotels but does not give any guarantee as to the integrity and accuracy of this information. The BFC accepts no responsibility for the actions of the Hotel Members.

b) If you plan to engage in a financial or other transaction with one of our Hotel or Restaurant Members or with another party whose contact is obtained through the BFC you should take every precaution, including performing due diligence and checking information found in the BFC against other sources, before engaging in such a transaction. You alone are fully responsible for the results of such transactions.

c) The BFC is not a service for the booking of its Hotel or Restaurant Members. We do, however, provide links to both member hotels' booking systems and to professional, third-party hotel booking services for your convenience. The BFC cannot be held responsible for the conduct of third parties to whom it provides links, nor does the provision of such links by the BFC constitute any form of endorsement or guarantee of the services of those parties.

d) If you engage the services of such third parties contacted through the BFC you do so at your own risk and should perform due diligence prior to doing so.

9. varying cultural sensitivities

a) Because of great variances in cultural values between different communities and countries that have access to this website there is a real possibility that you may be exposed to materials that you find objectionable or offensive. While The Beachfront Club wishes to avoid offense to any community it cannot censor all materials nor cater for all those with differing cultural values. We ask that if you find images or materials posted to this site offensive to change to a new location on the site or, if this is still not satisfactory, to stop using the site entirely.

b) The BFC may create a partially-restricted 'sensitive' zone in which some beach nudity is displayed. You must guarantee that you are at least 18 years of age, or meet the minimum age requirement of your country of residence, before accessing this area of the website.

10. termination of account by either party

a) You may terminate your account and profile with The Beachfront Club at any time for any reason by using the form under 'Community' in the Global Navigation Bar at top of most pages

b) The BFC may terminate your account and profile at any time without giving advance warning and without recourse if it has reason to believe you have not followed the Terms & Conditions of this website, or if it has any other reason it believes justifies such action.

c) In both cases of termination as listed above content uploaded by you will not necessarily be removed from the website. Such content may remain in various locations of the website in accordance with the terms in clause 4.3 above.

d) These Terms & Conditions will remain in effect in their entirety even after termination of an account by either party.

11. unauthorized actions

a) You agree not to misuse The Beachfront Club website in any way, including but not limited to the following:
